Conquering Denied Claims

Introduction

Imagine you are a veteran, and you are looking forward to claiming what belongs to you, but you get denied because of “lack” of evidence? This scenario happens daily, and many veterans just like you might think that it is impossible to reopen a case. Sometimes this happens because there is a lack of information out there available for veterans. Despite this lack of information let’s focus on the main point of this lecture: REASONS!

Insufficient Evidence Leading to Denials and the Path to Reopening

One of the reasons why VA claims are denied is because sometimes the evidence provided was not enough. This word ‘denied’ might sound scary, but it is not the end of the world; probably not all evidence or documents were submitted and all you must do is include new supporting evidence or the missing documents. Having that new evidence or information will help your case be reopened in hopes of a new and favorable outcome.

Just in case that seems a little complicated, that’s when we come in to help you speed up your denied claim. Remember that even if you do not have access to all needed documentation, we “Warrior Allegiance” are here for you to provide resources for the recovery of your military documents.

Medical Denials and the Importance of Updated Records

Now let’s talk about another reason why claims are denied, and it is kind of connected to the first reason listed above. We previously discussed how sometimes claims are denied because of the lack of evidence or missing documents right? Well, to be more specific, claims can also be denied medically speaking. For example, suppose you have a current 40% disability rate because of whatever condition and sometimes a condition can worsen gradually, right? Well, if you are planning on getting an increase because you feel your condition is worse you will need to submit up-to-date medical record.

Warrior Allegiance’s Medical Support for Claims

We really meant the word NEED, if you do not submit the new medical record your claim will be denied by the VA even if the altered condition is visible and evident. Just in case you were wondering, Warrior Allegiance can also help you with these types of claims thanks to our network of knowledgeable doctors that specialize in veterans’ claims. Remember this applies to both mental and physical conditions.

The Significance of Nexus Letters

Speaking about medical records, do you know what a Nexus letter is? It is a letter that provides a medical professional’s expert opinion linking the veteran’s medical condition or disability to their military service. This letter serves as evidence to establish a direct connection between the veteran’s service and the current health condition, making it easier to secure disability benefits from the Department of Veterans Affairs (VA).

The Importance of Accurate Personal Information

Before we proceed with some other reasons, we will ask you the following question: Do you feel confident about what is your full name, what is your current address or any other personal information? Even if the answer is yes, remember we are all humans and we all can make mistakes. You might have all the proper and needed documentation to file a claim to the VA, but the smallest mistake on your personal information will result in a denied claim! Please make sure you double-check your documents; you do not want to wait more time (it is up to the VA as to how long it will take to finalize the claim) because you mistakenly misspelled your last name or your address for example.

Integrity Matters: Avoiding False Information

We believe you will not commit the mistake of lying to the VA to get your deserved compensation, even though the VA job is to help you get your benefits, it is also their job to make sure the information provided is real. Do not delay the process by intentionally providing false information, as it is not only about wasting time but also risking penalties that could extend the time needed to finalize your case for years. That counts as another reason, and we understand sometimes all you want is to receive what you deserve but it is better to go in the right direction to avoid additional time.

Timing Matters in VA Claims

To continue with the reasons, many veterans think that there is a deadline to apply for VA benefits, but there is no deadline. We always recommend that you submit as soon as possible, but some veterans mix up these deadlines.  The VA may deny your claim if you fail to send additional forms or don’t schedule a doctor’s visit within a specific period. As we mentioned before, it is up to the VA how long will it take to finalize a claim, so by turning your documents before the deadline will increase your chances of getting a faster result. Remember you are not the only veteran submitting a claim!

Submission of Correct Forms

A common reason that veterans sometimes face is submitting wrong forms to the VA. Each case differs, and you must ensure that you submit only the required documents. For example, consider the form 21-8940, which you specifically need when applying for Individual Unemployability disability benefits due to a service-connected condition preventing you from maintaining a steady job. For the most part, forms have a specific number instead of a name and that can create a lot of uncertainty. Again, remember to double-check (maybe triple check) what you are submitting before you regret being denied by a NUMBER!
